[Tenancy] What should I do if I discover that my landlord owes money after renting a house?

how to write a tenancy agreement in Malaysia

What should I do if I discover that my landlord owes money after renting a house?

A woman posted on Twitter that her newly rented apartment’s landlord not only owes over RM10,000 in management and maintenance fees, but also refuses to pay and compromise on the rent.

How to avoid similar situations?

Sign a tenancy agreement contract before renting a house.

Is a verbal agreement sufficient? Does it have legal effect?

Section 10 of the Contract Act 1950;

2. Section 213(2)(a) of the National Land Code

states that a verbal tenancy agreement is legally binding.

Then why do we still need to sign a tenancy agreement contract?

If the obligations and responsibilities of the landlord and tenant are not clearly stated in writing, any disputes that arise may become ambiguous, and both parties may not be able to resolve the issue.

So, with a tenancy agreement contract, if there is a dispute, you can seek justice in court based on the terms of the contract, right?

That’s correct, but it must be ensured that the tenancy agreement has been stamped with a stamp duty by the Inland Revenue Board (LHDN) to make it legal in court.
