My husband cheated, can we punish the third party (mistress) with the law?

 

Would it be useful to report to the police?

 

Adultery is not a criminal offense and does not violate the Criminal Code.

 

Can we sue the third party?

 

According to Section 58(1) of the Law Reform (Marriage and Divorce) Act 1976:

If you are applying for a divorce in court, you can include the third party in the divorce proceedings and also sue the third party.

 

How will the law punish the third party?

 

If the court finds that the third party had an affair with your husband, they will have to compensate the wife financially. The maximum amount of compensation is RM100,000.

 

What if I don’t want a divorce?

 

If you do not intend to file for divorce, you cannot include the third party in the divorce proceedings and obtain compensation.
