Can the landlord sublet the room again?<\/strong><\/p>\n

If a house is overcrowded, violating fire regulations, the local council can take action against the landlord.<\/p>\n

According to Section 79 of the Local Government Act 1976, the definition of “overcrowding” of a residential dwelling is that the number of adult occupants plus two children under 10 years old is considered as one adult, and the occupied space must have a net area of 350ft\u00b3, which is roughly 10m\u00b3.<\/p>\n

Violators may be fined up to RM2000, or imprisoned for up to 6 months, or both.<\/p>\n

If violators fail to make improvements in a timely manner, they may be fined RM100 per day until the standards are met.<\/p>\n

What if I want to partition the house or turn it into a short-term rental like Airbnb?<\/span><\/p>\n

You must check with the Joint Management Body (JMB) of the apartment if it is allowed, and apply to the local council.<\/p>\n

According to the Strata Management Act 2013, a fine of up to RM200 may be imposed for non-compliance with the management rules.<\/p>\n

In addition, if a fire or electrical accident occurs in a non-compliant dwelling, the insurance company will not compensate for the damages.<\/p>\n
