Is it illegal to be part of this community?
In Malaysia, there are no laws that specifically criminalize being part of the LGBTQIA+ community. This means that it is not illegal.
Then why do some homosexuals still get arrested?
While sexual orientation itself is not illegal, there are laws that criminalize certain sexual acts.
Section 377A of the Penal Code:
“carnal intercourse against the order of nature,” which includes oral and anal sex.
Those convicted under this law can face up to 20 years in prison and whipping.
As a result, same-sex couples in Malaysia cannot legally marry or adopt children.
